This Message Covers Additional Reporting Requirements for Manufacturers Registered in California Only
On September 29, 2024, Senate Bill 1143 was signed into law by California Governor Gavin Newsom. The new law, PRC 48702(c), amends the PaintCare law and affects the reporting requirements for manufacturers in that state. The law requires the following information to be submitted to the Department of Resources Recovery and Recycling (CalRecycle):
- “A list of all participating manufacturers and their contact information, including names, physical and mailing addresses, email addresses, and telephone numbers.”
- “A list of paint products and brands of paint products that each manufacturer sells, distributes for sale, imports for sale, or offers for sale in or into the state. The list shall be disaggregated according to manufacturer or retailer.”
To gather the required information necessary to comply with the above reporting requirements, PaintCare is updating its manufacturer reporting portal at www.paintcarereporting.org.
On August 26, manufacturers will be sent an email prompting them to log into their accounts and update their contact information, including providing the name, email address, and phone number for the business principal. In addition, manufacturers will need to review their list of registered brands and indicate if the brand may be publicly associated with the manufacturer. Any brand that is manufactured under a private label agreement or other proprietary business relationship should be marked confidential.
Additional details and instructions will be provided once the portal update is available on August 26. Note that the new requirements may necessitate a level of coordination within a company that was not previously required. Please log in to the portal as soon as you are prompted to ensure timely coordination of responses. PaintCare requests that manufacturers provide the requested information no later than September 30.
